Terms of Service

1. Who these terms cover

"AffirmGear," "we," and "us" mean AffirmGear, a US-based company reachable at hello@affirmgear.com. "You" means the person or company using our site or placing an order. If you order on behalf of a company, you confirm you have authority to bind it to these terms.

2. Quotes and orders

• Prices shown in the Design Studio and on quotes are all-in for the stated quantity, size mix and destination: garments, design work, decoration, packaging and delivery within the United States. A sample set, if you want one before the bulk run, is quoted separately. Quotes are valid for 30 days.
• Volume discounts (currently 12% at 50 units, 22% at 150 units per order) are applied automatically and stated on the quote.
• An order becomes binding when you approve production in writing (including approval through the Studio). Until then, you can revise or cancel freely.
• Orders start from 15 pieces; if you need fewer, tell us what you have in mind. Reorders keep your design, colorways and size history on file and are quoted on the quantity you request.

3. Design and approval

• Design services — Studio proposals and human designer refinement — are provided free as part of the ordering process.
• You approve the final artwork, colors, placements and size list before production begins. What you approve is what we make; please check names, sizes and spellings carefully, because personalized items are produced exactly as approved.
• Physical samples are the authoritative color reference. A paid sample set is available before a bulk run and takes about two weeks. Screens vary; if color precision matters to you, approve the sample, not the render.
• Minor commercial tolerances apply, as in all garment manufacturing: fabric weight ±5%, decoration placement ±1 cm, and slight dye-lot variation between production runs.

4. Your content and intellectual property

• You keep all rights to the logos, brand assets and artwork you upload. You grant us a limited license to use them solely to design, produce and deliver your orders.
• You confirm you have the rights to any material you upload, and that your order doesn't infringe anyone's trademarks or copyrights. We may decline orders that appear to infringe or that contain hateful or unlawful content.
• Original patterns, colorways and designs we create for you may be reproduced by us only for your orders and reorders. We won't sell your design to anyone else — exclusivity is the product.
• We only feature customer work in our portfolio or marketing with written permission.

5. Payment

Payment terms are stated on your quote — typically payment at production approval, with invoicing available for established business accounts. Late invoice payments may accrue interest at the lesser of 1.5% per month or the maximum allowed by law. Applicable sales taxes are stated on the quote.

6. Production, delivery and risk

• Standard production is three weeks from the day you approve your design, followed by about two weeks of shipping. These are good-faith estimates we hit the overwhelming majority of the time, not guaranteed dates, though we'll always tell you promptly if something slips.
• We currently ship within the United States only; international orders are not offered at this time. Risk of loss passes to you on delivery; if a shipment is lost or damaged in transit, we handle the carrier claim and remake the affected goods.
• You're responsible for providing accurate shipping addresses, including recipient addresses on split shipments.

7. Custom goods, defects and remakes

• Custom-made goods cannot be returned or exchanged for change of mind — every piece is produced to your approved design. This is why design approval, and a sample set if you choose one, come first.
• Remake guarantee: if any piece arrives with a manufacturing defect — flawed stitching, decoration errors, wrong size versus the approved list, damage — report it within 30 days with photos and we will remake and reship it free of charge. Full details in Shipping & Returns.
• Variation within the tolerances in Section 3, and wear resulting from care contrary to the provided care instructions, are not defects.

8. Acceptable use of the site and Studio

Don't misuse our services: no attempting to breach security, scraping at scale, uploading malware, or using the Studio to generate designs for the purpose of producing them elsewhere in violation of a partner's rights. We may suspend access for abuse.

9. Disclaimers and liability

Except as expressly stated in these terms, our services are provided "as is" and we disclaim implied warranties to the extent the law allows. Our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential damages — lost profits, missed events, or similar — though we'll always work hard to make things right when problems occur. Nothing in these terms limits liability that cannot lawfully be limited.

10. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Before any formal proceeding, both sides agree to try to resolve disputes by contacting each other directly — in our experience, an email to hello@affirmgear.com resolves nearly everything.

11. Changes to these terms

We may update these terms from time to time. The version in effect when you approve an order governs that order. Material changes will be posted here with an updated effective date.
